Vito API Terms of Service

These Vito API Terms of Service (this “Agreement”) form a binding legal agreement between you (the “Developer,” “you”) and Vetox governing your access to and use of the Vito API and related developer tools, endpoints, credentials, and documentation (the “API”). By submitting a developer application, requesting or using an API key, or accessing or using the API in any way, you accept this Agreement in full.

• If you do not agree to this Agreement, you must not apply for, access, or use the API.
• You must be at least the age of majority in your jurisdiction and have the legal capacity to enter into this Agreement.
• If you access the API on behalf of an organization, you represent that you are authorized to bind that organization, and “you” includes that organization.
• This Agreement applies in addition to the Vetox Terms of Service, Privacy Policy, and all other Vetox policies, which are incorporated by reference; for API matters, this Agreement controls in the event of a conflict.

API access is reserved for approved developers who maintain an active paid Vetox Membership.

• API access requires an active paid Vetox Membership of Silver tier or higher at all times.
• If your Membership lapses beyond its grace period, your API access is automatically suspended and is restored only when your Membership is active again.
• Vetox may change the Membership tier, plan, eligibility criteria, or other requirements for API access at any time.
• You are responsible for maintaining eligibility, and loss of eligibility does not entitle you to any refund or credit.

The API is licensed, not sold, and access is a revocable privilege, not a right.

• Subject to your continued compliance with this Agreement, Vetox grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access the API solely for your approved project.
• API access is a privilege, not a right; Vetox grants no ownership and you receive no rights other than those expressly stated here.
• Vetox may suspend, restrict, modify, or revoke your access at any time, with or without cause, and with or without prior notice, at its sole discretion.
• You may use the API only for the project and purposes described in your approved application; any materially different use requires a new application.
• All rights not expressly granted to you are reserved by Vetox.

Access begins only after Vetox approves your application, which Vetox grants or denies in its sole discretion.

• You must submit a complete and accurate developer application, and Vetox may approve, reject, or request changes to any application at its sole discretion and without any obligation to give reasons.
• Vetox may reject, suspend, or terminate any application, project, or API key at any time, without prior notice, where it deems this necessary to protect Vetox, its users, or its infrastructure.
• You must keep your application information current and promptly notify Vetox of any material change to your project, its ownership, or your contact details.
• Providing false, misleading, or incomplete information is grounds for immediate rejection, suspension, or termination.

Your API key is a confidential credential, and you are fully responsible for protecting it.

• You must store API keys, signing secrets, tokens, and other credentials securely using appropriate, industry-standard security measures, and keep them strictly confidential.
• You must never commit credentials to source control, embed them in client-side, distributed, or public code, or otherwise expose them publicly.
• You must not share, sell, rent, lease, sublicense, transfer, assign, publish, or otherwise make your API key or access available to any third party.
• You are solely responsible for all activity that occurs under your API key, whether or not you authorized it.
• You must rotate credentials promptly when prompted and immediately notify Vetox of any actual or suspected compromise, loss, or unauthorized use.
• Vetox may revoke, rotate, or invalidate any credential at any time to protect the API, its users, or its infrastructure.

You may use the API only in lawful, good-faith ways consistent with this Agreement and your approved project.

• You may use the API only for the legitimate, approved use cases described in your application.
• You must operate within all published rate limits, quotas, scopes, and fair-use thresholds.
• You must obtain and honor all required end-user consents, including explicit PIN confirmation for every balance deduction or transfer.
• You must accurately represent your application, its operator, and its relationship (or lack of one) to Vetox to your end users.
• You must maintain reasonable security, monitoring, and incident-response practices for your integration.

You must not engage in any of the following, and Vetox treats any such activity as grounds for immediate suspension or termination.

• Using the API in any way that could cause Vetox or its Discord applications to be suspended, restricted, rate-limited, deverified, terminated, or otherwise penalized by Discord or any third party.
• Abuse, spam, fraud, deceptive or manipulative practices, money laundering, or any unlawful, harmful, or malicious activity.
• Prohibited, abusive, or undisclosed automation or bulk operations, or any attempt to manipulate, inflate, drain, or falsify balances, transactions, or activity.
• Scraping, harvesting, bulk-extracting, or enumerating data, users, or identifiers beyond what your approved use strictly requires.
• Bypassing, disabling, fabricating, caching, replaying, or otherwise circumventing PIN confirmation, authentication, rate limits, quotas, or any other security control.
• Reverse-engineering, decompiling, probing, scanning, penetration-testing, or attempting to discover or defeat the API’s source, structure, or security, except to the limited extent such a restriction is prohibited by applicable law.
• Reselling, redistributing, sublicensing, or offering the API or its data as a competing, standalone, or proxy service.
• Interfering with, disrupting, overloading, or degrading the API, Vetox infrastructure, or other users or developers.
• Using the API to process, store, or transmit content that is illegal, infringing, malicious, or that violates Discord’s policies or this Agreement.
• Misrepresenting your identity, your application, or your authorization, or impersonating Vetox, Discord, or any other person or entity.
• Circumventing or attempting to circumvent any Membership requirement, eligibility check, suspension, ban, revocation, or other enforcement action.

Because the API operates within the Discord ecosystem, strict and continuous Discord compliance is mandatory.

• You must comply at all times with the Discord Terms of Service, Discord Developer Terms of Service, Discord Developer Policy, Discord API Terms, and Discord Community Guidelines, as each may be updated.
• You must not use the API in any manner that violates, or that would cause Vetox to violate, any Discord term, policy, or guideline.
• You must not take any action that could place Vetox, its bots, or its Discord applications at risk of suspension, restriction, loss of verification, or termination.
• If Discord changes its policies in a way that affects the API, you must promptly conform your use to the updated requirements.
• Vetox may immediately suspend or terminate your access in order to comply with, or to avoid violating, any Discord requirement, policy, or request.

You must respect all limits at all times and never attempt to evade them.

• You must stay within all published rate limits, quotas, and fair-use thresholds, which may vary by Membership tier and may change at any time.
• You must not use multiple keys, accounts, projects, IP addresses, or any other means to exceed, split, pool, or otherwise circumvent any limit.
• Vetox may throttle, queue, degrade, or reject requests, and may impose additional limits, to protect the API and its users.
• Automated, excessive, or abusive request patterns may result in immediate throttling, suspension, or termination.

End users own their Vito, and you must obtain valid authorization for every sensitive action.

• Every balance deduction or transfer requires the end user’s explicit PIN confirmation, which you must never bypass, fake, cache, reuse, or circumvent.
• You may act on a user’s Vito only with that user’s valid, current authorization, and only to the extent the user has consented.
• Before a user authorizes your application, you must give clear and accurate information about what it does with their Vito and data.
• You must immediately stop acting on a user’s behalf upon revocation of their consent or upon their request.

You must handle all user and personal data lawfully, securely, and only to the extent necessary.

• You must comply with all applicable data-protection and privacy laws, including the GDPR, UK GDPR, and CCPA/CPRA, where they apply to you.
• You must collect, use, and retain only the minimum data necessary for your approved use, and only for as long as necessary.
• You must protect all user data and credentials with appropriate technical and organizational security measures.
• You must maintain a clear, accurate, and accessible privacy policy that discloses your data practices to your users.
• You must not sell, rent, or share user data, or use it for advertising, profiling, or any purpose beyond your approved use, without the user’s explicit consent and a lawful basis.
• You must delete user data on the user’s valid request, on termination of your access, or when it is no longer needed, except where retention is required by law.
• You must promptly notify Vetox and any affected users of any data breach involving data obtained through the API, as required by applicable law.

Vetox retains all rights in the API and its brand.

• Vetox and its licensors own all right, title, and interest in and to the API, including all software, documentation, data structures, and intellectual property, and you receive no ownership rights.
• “Vetox,” “Vito,” and related names, logos, and trademarks are owned by Vetox, and you may not use them except as expressly permitted in writing.
• You must not use Vetox branding in any way that is misleading or disparaging, or that implies sponsorship, endorsement, partnership, or affiliation, without Vetox’s prior written permission.
• You must follow any attribution and branding requirements Vetox provides, and you grant Vetox the right to reference your application’s name and logo to identify it as an API user.
• You retain ownership of your own application, excluding any Vetox or third-party materials.

Vetox may end your access at any time, and you may stop using the API at any time.

• Vetox may suspend, restrict, revoke, or terminate your access, any project, or any API key at any time, with or without cause, and with or without prior notice, at its sole discretion.
• Vetox may act to protect Vetox, its users, its infrastructure, or its standing with Discord, or to address any actual or suspected violation, and is not required to establish a violation before acting.
• You may terminate this Agreement at any time by ceasing all use of the API and requesting deletion of your credentials.
• On termination or suspension, your license ends immediately, and you must stop all use of the API and delete all credentials and any non-public data obtained through it.
• Termination does not entitle you to any refund, and Vetox is not liable to you or any third party for any suspension, revocation, or termination.
• Provisions that by their nature should survive termination, including those on security, data, intellectual property, disclaimers, limitation of liability, indemnification, and governing law, survive.

Vetox may verify your compliance with this Agreement.

• Vetox may monitor, log, and analyze API usage to operate the service, enforce this Agreement, and protect the API and its users.
• Vetox may investigate suspected violations and may require you to provide information reasonably necessary to verify your compliance.
• Where legally appropriate, Vetox may audit your use of the API and your relevant security and data practices on reasonable notice.
• You must cooperate in good faith with any investigation or audit, and a failure to cooperate is itself a violation of this Agreement.

The API is provided on an evolving, as-available basis.

• The API is provided “as is” and “as available,” and Vetox does not guarantee any level of uptime, availability, performance, or continuity.
• Vetox may modify, add, deprecate, suspend, or discontinue any part of the API, including endpoints, features, scopes, rate limits, and quotas, at any time.
• Vetox may change the Membership requirements, pricing, fees, and any other commercial terms applicable to API access at any time.
• Vetox will use reasonable efforts to communicate material breaking changes where practicable, but is not obligated to do so.
• You are responsible for keeping your integration compatible with the current version of the API.

To the maximum extent permitted by law, your use of the API is at your own risk.

• The API and all related materials are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.
• Vetox does not warrant that the API will be uninterrupted, error-free, or secure, or that any data will be accurate, complete, or preserved.
• To the maximum extent permitted by law, Vetox and its operators, affiliates, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, Vito, or business, arising out of or relating to the API or this Agreement.
• To the maximum extent permitted by law, Vetox’s total aggregate liability arising out of or relating to the API or this Agreement will not exceed the greater of the total amounts you paid to Vetox for API access in the three months before the event giving rise to the claim, or USD 50.
• You will defend, indemnify, and hold harmless Vetox and its operators, affiliates, officers, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of the API, your application, your violation of this Agreement or any law, or your infringement of any third-party right.
• Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you; in that case, Vetox’s liability is limited to the maximum extent permitted by applicable law.

You are responsible for the legality of your use everywhere it operates.

• You must comply with all applicable local, national, and international laws, regulations, and rules in connection with your use of the API.
• You must comply with all applicable export-control, sanctions, anti-money-laundering, consumer-protection, and tax laws, and you may not use the API where doing so is prohibited.
• You represent that you are not located in, and will not access the API from, any embargoed or restricted jurisdiction, and that you are not a restricted or sanctioned party.
• You are solely responsible for determining whether, and how, your use of the API is lawful in each jurisdiction in which you operate.

This Agreement may change over time, and the following general provisions apply.

• Vetox may modify this Agreement at any time; material changes take effect when posted or otherwise communicated, and your continued access to or use of the API after that constitutes acceptance of the revised Agreement.
• This Agreement is written in English, which is the sole authoritative and binding version; any translation is provided for convenience only, and in case of any conflict or inconsistency the English version controls.
• If any provision is held unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions remain in full force and effect.
• This Agreement, together with the documents it incorporates, is the entire agreement between you and Vetox regarding the API and supersedes any prior or contemporaneous understanding on its subject.
• Vetox’s failure to enforce any provision is not a waiver of that or any other provision.
• You may not assign or transfer this Agreement or your access without Vetox’s prior written consent; Vetox may freely assign it. This Agreement binds permitted successors and assigns.
• Nothing in this Agreement creates any partnership, agency, employment, or joint-venture relationship, and there are no third-party beneficiaries; Vetox is not liable for any failure or delay caused by events beyond its reasonable control.
